CARSTUFF TRACK RENTAL AGREEMENT
Included Services: Trackside assistance; All necessary fuel for the entire rental session; One set of tires for use during rental
Note: Renter will be responsible for any tire damage beyond normal track wear, including but not limited to punctures, flat spots from lockups, sidewall damage, or off-track incidents.
2. INSURANCE (OPTIONAL)
Renter must provide proof of valid track-day insurance covering physical damage and liability for the entire rental period.
Failure to provide insurance will result in immediate cancellation with NO refund.
3. LIABILITY
3.1 Insurance Recommendation
Insurance is not required, but it is strongly recommended. Renters who do not provide valid track-day insurance will be personally and fully responsible for all damage and associated costs arising from vehicle use.
3.2 Responsibility Without Insurance
If the renter does not provide valid track-day insurance, they agree to:
Be fully liable for all damage incurred during the rental period.
If the repair cost exceeds 60% of the vehicle’s declared value (as listed in the rental agreement), the renter must purchase the vehicle at its full declared value.
Pay the following costs, as determined by CARSTUFF through post-event inspection:
1. Full parts and labor costs based on current market rates;
2. Loss of use compensation at $200/day, calculated by the number of missed track days during vehicle downtime;
3. Towing or transport costs, if applicable;
4. Lost revenue from cancellations due to the vehicle being unavailable for future rentals.
A post-rental inspection will be conducted after the vehicle is returned. CARSTUFF reserves sole discretion to determine the cause, extent, and cost of any damage or liability.
All payments related to damage, downtime, or associated loss must be made within seven (7) days of notice.
3.3 Responsibility With Insurance
If the renter provides an insurance policy (personal or third-party), they acknowledge and agree that:
Insurance does not release them from financial responsibility for any damage, loss, or liability not covered by the policy.
The renter remains fully responsible for:
Deductibles;
Coverage limits exceeded by repair costs;
Policy exclusions or denied claims;
Loss of use compensation, towing, and administrative costs.
In all such cases, the renter agrees to pay the full remaining balance not paid by the insurer within seven (7) days of notification by CARSTUFF.
CARSTUFF is not obligated to accept partial or delayed payments from third-party insurers in lieu of full and timely restitution by the renter.
4. OPERATIONAL RULES
Vehicle use is strictly limited to the racetrack and paddock area.
The vehicle must not be driven outside the track or paddock area under any circumstances.
No drifting, burnouts, off-track excursions, or reckless driving unless explicitly authorized by CARSTUFF.
CARSTUFF may terminate the rental immediately if the renter operates the vehicle unsafely or violates any rule.
5. CANCELLATION, RESCHEDULING, WEATHER, and REFUND POLICY
5.1 Rescheduling
Rescheduling requests must be made at least 5 days in advance.
One reschedule is allowed per booking.
Rescheduling is not guaranteed and is subject to availability.
5.2 Cancellations and No-Shows
No refunds will be issued for cancellations within 72 hours of the scheduled session.
No refunds for no-shows.
No refunds for mechanical damage caused by the renter.
5.3 Weather and Force Majeure
Events operate rain or shine.
If the track is closed due to extreme weather or force majeure ("Act of God"), a reschedule or credit may be issued.
Weather-related personal conflicts are not refundable.
5.4 Refund Eligibility
Refunds or credits may be issued only if the vehicle becomes inoperable due to mechanical failure not caused by the renter.
CARSTUFF reserves full discretion in evaluating refund or reschedule requests.
7. LIABILITY WAIVER INDEMNITY
Renter acknowledges the inherent risks of motorsports and agrees to:
Release CARSTUFF, LLC and its personnel from all liability for injury, death, or property damage resulting from vehicle use or track participation.
Indemnify CARSTUFF from any legal claims or financial losses caused by the renter’s actions or negligence.
Sign any additional liability waivers required by the racetrack or hosting organization.
8. GOVERNING LAW
This Agreement shall be governed by the laws of the Commonwealth of Massachusetts. Any dispute arising from or related to this Agreement shall be resolved in the courts located in Essex County, MA.
9. MINIMUM REQUIREMENTS
Drivers must be 18+ years old with a valid driver’s license.
Ride-along passengers must be 16+, and under 18 must provide a guardian waiver.
10. ACKNOWLEDGEMENT
By signing the track rental agreement, the Renter confirms they have read, understood, and agree to all terms of this Agreement, and that all information provided is true and accurate.
